Information about CPT
Foreign students studying in the United States who wish to take advantage of internship opportunities will need to get permission from the US Citizenship and Immigration Services (USCIS). No foreign student may take part in an internship or other education related job opportunity while studying in the US unless they have achieved a legal status called Curricular Practical Training, commonly referred to as CPT. Generally, Curricular Practical Training status is required for employment that is part of a course of study such as an internship, while Optional Practical Training, OPT, is required for jobs that are not part of the course of study.
Violation of US Immigration Law
Students who don’t require this practical training will be in violation of US immigration law if they take an internship, residency, research assistant’s position or similar paid job. CPT is not the same as OPT or Optional Practical Training. Optional Practical Training is a status that exists for employment opportunities outside of the education process that are directly related to the student’s course of study. Curricular Practical Training is for students who need to take a paying position as a formal part of their course of study.
How to Apply for Curricular Practical Training
To achieve Curricular Practical Training status, a student will first have to get recommended for it by a Designated School Official. This official is a school administrator or professor will start the CPT process by endorsing the student’s I-20 form. The school administration should be able to tell the student who their Designated School Official is. Once the student has gotten the endorsement from the official they will have to fill out form I-765 and file it with the USCIS. The USCIS will review the I-765 and if it is approved the student will receive an employment authorization document that will give them legal permission to work in the US.
Guidance and Information
Students will be able to find the I-765 and file it by going to the USCIS’s website. The Designated School Official and school administrators should also be able to students with this process as well. A student should file for Curricular Practical Training status as soon as they become aware of an internship opportunity so they can get the status approved in time for the internship. This should give the student an opportunity to deal with any problems they encounter with the process
CPT Restrictions
Foreign students who achieve this status should realize that Curricular Practical Training is a very limited status. The employment is restricted only to opportunities like internships. Students with CPT status will only be able to work at the specific internship or similar opportunity they have requested the status for. Students will have to fill out another I-765 and go through the process again if they want to sign up for a different internship.
Students with this status will not be able to work at other paying jobs on campus, off campus jobs, or any other kind of paid employment. Nor will they be able to operate a business or work as an independent contractor. International students who wish to take advantage of job opportunities related to their field of study will have to apply for another special status called Optional Practical Training or OPT.
