Like all human beings, every student has certain rights. Therefore, no institution should infringe upon these rights. In many cases, a school may decide upon an agreed set of student rights and responsibilities based on these human and United States rights for both citizens and foreign nationals. Often, students will be subject to these rules and regulations set forth by an individual school. Most likely, a student will be disciplined should they take unfair advantage of student rights and/or act against responsibilities. These rights and responsibilities are set forth to protect the school and students while still creating a pleasant learning environment for everyone.
Student Rights in a Public School
As set forth by the Constitution, every student has the right to freedom of speech. He or she is free to express opinions provided that personal attacks or interference with other student’s rights are not present. Furthermore, among the list of student rights and responsibilities, each student has the right to assembly which states that students are allowed to congregate on any given date provided that there is no inappropriate behavior involved.
Students also have the right to petition the authorities if they have been cheated and treated unfairly. Moreover, freedom of the press rights applies to students as well. Each student may express their thoughts in writing provided that they take full responsibility for the publication. However, international students on a student visa should be careful not to cross the line if it could result in expulsion or deportation.
Students Have the Right to Privacy
The list of student rights and responsibilities also include certain rights that pertain to privacy such as freedom from unreasonable search and seizure. There is much controversy over this rule as a result of terrorist activity, so certain ‘rights’ that were once open to foreign nationals are now being re-examined. However, the following rules will apply. Searches of school property such as lockers or desks can be performed without notice. Firearms or other weapons or things similar that may be viewed as a reasonable threat can be searched anytime.
Suspicion of contraband involving a student can also legally result in the searching of a student’s person. Aside from privacy rights, each student also has the right to equal education opportunity. No student shall be discriminated against because of origin, race, religion, sex, sexual orientation, gender, marital status, or criminal record. Finally, each student also has the right to freedom of religion. A student has the right to participate in any religious views that they choose.
Responsibilities of a Student
Responsibilities of a student are usually chosen by individual schools. Most of these responsibilities will involve attitude and interaction amongst other students. Student rights and responsibilities will request a student to respect the rights of other students, avoid discrimination or personal prejudices, attend classes that he or she are enrolled in, and make a conscious effort to learn.
Furthermore, it will be requested of the students to understand the rules of each individual school and be willing to follow instructions of professors. They must also accept disciplinary action for rules that have been broken. Finally, each student will be asked to dress appropriately in a way that is safe and does not cause disruptions and respect the property of all others students that attend school also.
