Law Clerk Job Description
|
Law clerks form an integral part of the judicial system by assisting judges and attorneys in research and preparation of legal documents. Without their clerical support judges and attorneys will find it hard to function.
Law Clerk Job Duties
Law clerks obtain information from all possible sources to prepare a case and research laws applicable to it. Other duties require them to:
1) Provide supporting rules and earlier court decisions to help make a case stronger.
2) File pleadings and petitions.
3) Prepare drafts, affidavits and briefs.
4) The briefs prepared by law clerks help attorneys in fighting the case. Law clerks may prepare briefs completely on their own or may be directed by attorneys to search a particular section of legal literature.
5) Maintain correspondence with everybody concerned with a case.
6) Supply copies of pleas to the opposing lawyer.
7) Deliver subpoenas (court order for summoning witnesses or submitting evidence) to witnesses and parties involved in a case.
8) Store all necessary documents in digital format.
9) Arrange for transport for witnesses and legal professionals involved in cases.
10) Arrange meetings of legal professionals related to a case.
11) Act as communicator and arbitrator between parties.
Law Clerk Knowledge and Skills
1) Knowledge of local, state, and federal laws, legal codes, court procedures, and court rulings etc.
2) Excellent research skills. Should have thorough knowledge of sourcing legal information.
3) Solid reasoning ability. Should have the capability to understand the implications of a ruling, relevance of a law, detect material that can be used as evidence and purposefulness of evidences.
4) Good knowledge of the English language, grammar and composition.
5) Stenography and transcription proficiency.
6) Familiarity with legal jargons.
7) Good administrative ability.
8) Good communication skills.
9) Must have the art of active listening.
10) Should be comfortable with public speaking and face-to-face interactions.
11) Should be able to work under time deadlines.
12) Should have an eye for accuracy while presenting facts and figures.
Law Clerk Educational Qualification and Skills
1) Graduate in law is eligible for this position
.
2) Master’s, doctoral degree, and professional degrees such as a paralegal degree to help in securing a job.
3) Five years of experience may be required in some places for law clerk position.
